New York State Senator Liz Kreuger(D, WF) recently introduced a bill to the State Senate that would begin regulation and taxation of marihuana. The short title of the bill is the “Marihuana Regulation & Taxation Act”. It is modeled after the laws enacted in Colorado and Seattle with the Liquor Authority of the state overseeing licenses for growing, distributing, and dispensing marihuana.

This legislation would remove criminal penalties for marihuana possession by those over 18 and allow those with criminal sentences to have those appealed. The bill would establish a control board to oversee license acquisition and separated dispensers from growers and processors. The state would also set a tax on marihuana sold to dispensaries and their patrons. Included in the legislation is the license for dispensaries with on-site use allowing marihuana bars to exist in NY.
