Portugal's Innovative Drug Policies Face Austerity Threat

At conferences and forums around the world, the Portugal model of drug policy is lauded by academics, politicians and service providers and highlighted as an example of effective policy-making. Ten years after decriminalizing personal use and possession of drugs and moving drug policy from being a law enforcement issue to one of public health, the results have been dramatic. The future of this policy now hangs in the balance due to austerity measures in Portugal. Without proper funding, this internationally recognized model will be distorted or discontinued.

This past week, the Conservative Political Action Conference (CPAC) drew thousands of politically active minds to Washington, DC to highlight the discourse on the right side of the aisle. Each year, CPAC draws more and more young people, students in particular, and this year there was noticeably stronger support and willingness to talk about reforming our nations’ drug policies among the those in attendance.

An Impressive Start

SSDP at SCSU is only two weeks old, but they are already off to an impressive start. Kevin Gysberg founded the chapter with the intention of reforming his campus's drug and alcohol policy, and that's exactly what he has begun to do. Despite their fresh start, Kevin and the rest of the students in the SCSU chapter have already begun drafting new legislation to equalize cannabis and underage alcohol possession violations; and it's shaking things up on campus.

Governor Quinn Signs Good Samaritan Bill into Illinois State Law

Yesterday, February 6th, Governor Quinn signed SB 1701 (known better as the Good Samaritan Policy or Overdose Immunity Bill), which has been on his desk since December 16th, marking the first time any policy of this sort has passed into law in Illinois. In layman’s terms, it establishes extended rights for drug offenders calling on behalf of someone overdosing. In a state where heroin overdose is among the worst in the nation, this bill was designed to try and reduce the harms of substances regulated by the Controlled Substances Act.

Following a meeting with student government leaders on January 30, 2011, the University of Connecticut’s Office of Community Standards altered its penalties for students found in possession of small amounts of marijuana, equalizing the punishment with underage drinking.

Yesterday in the weekly SSDP/UNAM (National Autonomous University of Mexico) chapter meeting, each group member shared their story of “why” they are involved in drug policy in 2 minutes. The stories that emerged were powerful. All of us have different reasons for becoming involved and as activists, we must articulate these stories in order to build the movement and motivate change. As Marshall says, “Public stories combine a “story of self”, a “story of us”, and a “story of now” into a call for action.”

SSDP’s backbone has always been the courageous students who dedicate their time and energy to speak out against the War on Drugs on their campuses and in their communities. Yet the work of these students, and the dedicated national staff that supports and empowers them, would not be possible were in not for the generous support of the organization’s financial donors, particularly those who provide as much advice and guidance to SSDP’s leadership as they do financial contributions. Few people embodied this spirit better than Dave Padden, an SSDP donor, supporter, friend, and mentor. I was deeply saddened when I recently heard the news that Dave passed away from a heart attack in October at the age of 84. Dave Padden was a man whose love of liberty and freedom guided his every move, including his generous support of SSDP and drug policy reform.

Illinois House passes life-saving overdose prevention bill

Today, October 27, 2011, the Illinois House passed SB 1701, the Emergency Medical Services Access Act to Save Lives, more commonly known as a Good Samaritan policy. ??Via collaborative efforts by the American Civil Liberties Union of Illinois, the Aids Foundation of Chicago, and various lobbying action entailed by Illinois Students for Sensible Drug Policy chapters, SB 1701 now only waits for Governor Pat Quinn to sign it into effect, becoming the law of the land (of Lincoln). Anticipations are high that Governor Quinn will have no reservations.

Outrageous drug search conducted at a CT high school

Early in the school-day, a school administrator announced over the public address system that a dangerous intruder had entered the school and that all students were to remain in their classrooms, away from windows and ideally huddled into one corner of the room. Once students were sufficiently terrified and secure in their classrooms, the search was conducted. According to a spokesperson for the Wolcott Police Department, no drugs were found during the search.

The Northeast Regional Conference was held this past weekend at Boston University and over 80 students attended a weekend filled with fantastic speakers and excellent training and discussions. Students from Maine, New Hampshire, Vermont, New York, Connecticut, Rhode Island and 5 different school from the Boston area gathered to strategize how to end the war on drugs. With the recent announcement by the Obama administration to crack down on Medical Marijuana states it is clear we will need as many savvy college organizers as we can get.

In a recent national board meeting this week, SSDP board members voted to endorse Californians United for a Responsible Budget and their Budget for Humanity Campaign. SSDP along with 45 other organizations have recently collaborated to support the new campaign and invest in California's future. Bloated by a failed policy of mass incarceration and laws such as Three Strikes and Mandatory Minimums, California’s prisons are filling at a far greater rate than even history’s largest prison expansion project can meet. CURB knows that California’s problems can only be solved through proper funding of education, community resources and prevention/intervention programs. We must fund communities, not cages, and begin a true effort in maintaining public safety for all Californians.

Yet Another Study Shows Student Drug Testing Doesn't Work

A new study is once again proving that student drug testing programs are ineffective at reducing drug use. The study, published online in the Journal of Youth and Adolescence, was based on a nationally representative sample of 940 high school students across the country. The teens were surveyed by telephone in 2007 and 2008.

Katharine: A few years ago, when I wasn't even a student! I was taking time off from school for health reasons. I'd been interested in mental health advocacy since about 6th grade, but my experiences with some self-identifying addicts inspired my interest in drug policy reform more specifically. As stigmatized as I felt for my own struggles, I realized my addict friends had it worse. When I got sick - I went to the doctor. My friends whose illnesses involved behavioral components tied to illegal substances faced incarceration. It was thus, in effect, illegal for them to be sick.

Yesterday, July 20th, Governor Cuomo signed A2063C – an overdose preventing “Good Samaritan” policy - into law. The purpose of the law is to encourage a witness or victim of an alcohol or other drug related medical emergency to call 911 to seek emergency assistance in order to save the life of a potential overdose victim.

Bolivia will withdraw because its 2009 Constitution requires the government to renegotiate treaties which violate the Constitution. A frequent question asked during these sessions, many people wonder, "what's the of point denying consent to a search? If a cop wants to search your car, they'll search it anyway." Well, NFL Defensive Tackle and former Florida State University student Darnell Dockett successfully asserted his rights yesterday during a police encounter Monday. Darnell even provided play-by-play live Tweets of the police stop!

Portland SSDP Chapters Team Up for Vigil

SSDP chapters at Reed College and Lewis & Clark College in Portland, OR, teamed up this past Friday and organized a candlelight vigil to commemorate those impacted by the failed war on drugs. Over 100 people were in attendance. The Portland chapters placed a focus on the struggle of medical marijuana patients in their state and throughout the country who needlessly suffer and face criminal prosecution for using cannabis. One of those patients was interviewed in the above video and explained that the war on medical marijuana forces patients into a dangerous black market:

Over the past three years, the U.S. War on Drugs has brought $400 million in fines to rail shippers on the U.S.-Mexican border. Now, The Associated Press reports, the largest U.S. railroad company Union Pacific is refusing to pay for something it cannot control. Following accusations of negligence from the Justice Department, Union Pacific vice president Bob Grimaila says the railroad cannot be expected to "send unarmed personnel into Mexico to battle Mexican drug cartels that maliciously murder and wage a war against the Mexican military."

A recent report by the Global Commission on Drug Policy opens with the straightforward claim: "The global war on drugs has failed, with devastating consequences for individuals and societies around the world." In The Wall Street Journal, former Secretary of State and honorary commission chair George P. Shultz decries our approach to America's drug problem by arguing that criminalizing the entire process has proven to be ineffective and wasteful. "Drugs are still readily available, and crime rates remain high." Through the course of our war on drugs, we have seen colossal overcrowding in our prisons by drug consumers who do not belong there in the first place. This leaves American taxpayers to foot the bill while leaving the lucrative and illegal drug market intact.

I'm not sure what the school administrators were thinking when they decided it was necessary to strip search 13 year old Savannah Redding because they suspected she was hiding ibuprofen in her underwear. Not only did the humiliating and unconstitutional search not find any of that oh-so dangerous ibuprofen, but those who carried out the search contended that they had done nothing wrong.

Just days ago, the U.S. House Judiciary Committee voted 16-9 in favor of a bill that would eliminate the 100-to-1 sentencing disparity between crack and powder cocaine offenses. The disparity in mandatory sentences has resulted in a disproportionate number of African-Americans being sentenced to lengthy prison stays for crack offenses, despite most cocaine users being white, without the drug's availability being significantly reduced.

Wow. I can’t believe it has been almost two weeks since I returned from my trip to Buenos Aires, Argentina, where the very first Latin American Conference on Drug Policy was held August 7-8. I have finally recovered from my amazing adventures, and I am so motivated for the future of global drug policy. After my visit to Buenos Aires, it has become more than obvious to me that the United States lags far behind much of the world in dealing with drug-related problems. (Perhaps because we “deal with drug-related problems” by continuing the same failed prohibition strategies over and over?) I didn't realize it when I left for the first Latin American Conference on Drug Policy in Argentina a few weeks ago (scroll down a couple of posts for more), but the country was on its way to setting a historical precedent in creation of sensible drug policy. While it may not be Portugal or Mexico, the new law is undoubtedly the first step in a new approach for the South American nation.

That's right! We have a chance to change one of the most destructive drug policies ever created. The HEA Aid Elimination Penalty has denied financial aid for college to more than 200,000 students with drug convictions. However, the 2009 SAFRA would make it so that this law would only apply to those convicted of selling drugs. Considering that nearly 90% of marijuana arrests are for possession only - this is a huge victory! Sadly, Rep. Mark "sneaky snake" Souder (R-IN), who created the penalty in 1998, has introduced an amendment to strike out that reform. But we can stop it.

Overall, I like the special and think it is fairly objective in showing the diversion of pharmaceutical drugs, the toll of addiction, and intentional or not, the shortcomings of law enforcement in drug policy.

Fired Cop Wins Suit

SEATTLE, WA -- A Mountlake Terrace police sergeant who was fired after publicly criticizing the "war on drugs" has reached an $812,500 settlement in a lawsuit he filed against the city and police department, among others. While my last post made light of the situation in El Paso, this event proved to be an important day for drug policy. Even though mayor Cook's veto was not overridden by the city council, councilman O'Rourke's goal to stimulate dialogue about ending prohibition was achieved. Over 40 people testified their support or disagreement with the veto's override. It seemed like most supported keeping all options on the table and not limiting discussion - whether or not they personally supported legalization.

North Dakota aims to Ban Alcohol at College Events

Representative Chuck Damschen (R-ND) has introduced a bill that would ban drinking or possessing alcohol at college sporting events if anyone under the age of 18 is attending the game. A two-person delegation from SSDP International traveled to New York from Washington, D.C. and San Francisco. International Liaison Patrick Timmons and International Outreach Daniel Pacheco went to lobby for and present the organization's application for consultative status before the Economic and Social Council's (ECOSOC) committee on non-governmental organizations. This nineteen delegate committee approves or defers NGOs' applications. Consultative status would allow SSDP to send delegates to all appropriate committees and meetings of the ECOSOC.

North Carolina is one of 23 states that have a tax on illegal drugs. I can’t speak to the way the others work, but in North Carolina the tax on illegal drugs is considered a purely civil issue. Thus, you can be acquitted of a drug crime and still be taxed on the drugs. The burden of proof is on the defendant, and the tax can be applied retroactively. Meaning if the state can reasonably demonstrate past drug possessions as well, then the tax can be levied on drugs long come and gone.

Gulab Mangal, the governor of an Afghani province, Helmand, wants to try a new approach to controlling opium poppies in his land. Helmand is the largest poppy producing province in Afghanistan, a lot of which goes to fund groups such as the Taliban and Al-Qaeda. He wants to stop the farmers from planting poppies, rather than destroy it once they plant it. His plan involves actively working with the farmers in his region to provide them with the seeds and training needed to grow new crops and improving their road systems so that farmers are actually able to get their product to the market.

I was invited to speak at this weekend's 2011 International Students for Liberty Conference in Washington D.C. This was my first experience as a speaker at a conference over 500. UMD SSDP helps pass Good Samaritan Policy

Four years ago, as a sophomore at the University of Maryland (and at the time President of the UMD SSDP chapter), I was elected to the University Senate, the most powerful policy making body on campus, comprised of 90% faculty, and 10% students. In an effort to place myself in a position to influence campus drug policy, I sought and received an appointment to serve on the Student Conduct Committee. There I proposed adopting a Good Samaritan (or medical amnesty) policy that would ensure students would be protected from judicial sanctions if they called 911 for themselves or a friend who needed emergency medical attention due to an alcohol or other drug overdose. I had no idea that this would mark the beginning of a very long, difficult, and complicated saga, culminating in a Senate vote that took place yesterday.

SSDP's 2011 Training Conference & Lobby Day was an inspiring weekend that really spoke volumes to SSDP's pivotal role in the effort to bring common sense to drug policy. We saw 400 students from all over the country come together not just to learn about policy, but to gain the tools needed to become effective activists - prepared to take on the challenges and opportunities facing us over the next two years. All told, we had students from 28 states and the District of Columbia representing 78 high schools, colleges, and universities across the U.S. in attendance last weekend!

Despite the Department of Justice memo advising the DEA and federal prosecutors not to spend resources arresting medical marijuana patients and raiding medical marijuana providers in states that have passed legislation protecting these people, federal agents have recently shut down 26 medical cannabis dispensaries in Montana and California.

One of SSDP's newest chapters, Lewis & Clark College located in Portland, OR, has jumped right into forming an active student group with a focus on reforming Oregon's marijuana laws. One thing I been incredibly impressed with is chapter founder Christopher Van Putten's enthusiasm and his ability to get the Lewis & Clark chapter officially recognized and up in running in just about one week! In order to reach a deal, Obama and Reid bowed to GOP demands to ban the District of Columbia from using any money to fund abortions.

Remembering Rachel Hoffman

Today marks the third anniversary of the murder of Rachel Hoffman, a former SSDP member and 23 year old graduate of Florida State University. Rachel was murdered by two drug dealers after the Tallahassee Police Department pressured her to become an informant in an undercover sting operation, promising to keep her safe, only to lose track of her.

The last few months have seen bodies heaped upon bodies in Mexico. In some cases, the heaping is quite literal: drug graves have been opened up in the northern Gulf state of Tamaulipas, the largest contained almost two hundred people. Authorities sent cadavers to Mexico City for identification by forensic specialists. Though killed by drug gangs, investigators in Tamaulipas suggest that the local police was complicit.

It was bad night for marijuana law reform. Proposition 19, the ballot initiative heard round the world, was defeated by California voters by a larger margin than supporters expected. The initiative still brought in 46% support - nothing to scoff at, and took the legalization issue to the forefront of American politics. It also left half-witted journalists scrambling to see who could use the headline "Prop 19 goes up in smoke" first.

Proposition 19 - Hidden Victories in a Hollow Defeat

With 100% of precincts reporting, California’s Proposition 19 fell less than 3.9% short of victory, leaving many in the media to focus on why Prop 19 did not get majority support. Ultimately the failure to pass Prop 19 will prove to be less important than what was gained during the campaign. Besides, how solid of a defeat could it have been when the opposition’s argument of greatest resonance was “if you are going to vote for legalization, this is not the bill to do it with?” That’s a tacit admission by the opposition that legalization is inevitable, a waving of the white flag while simultaneously fighting one last battle. A bizarre political tactic to be sure, but a sign for us that things are headed in the right direction.

What does the International Liaison Do?

My job makes me feel privileged. I'm the first International Liaison for Students for Sensible Drug Policy. My job enables me to travel outside the US, working with students and youth in other countries to set up SSDP chapters. It's a great task which requires patience and perspicacity to find out what issues and ideas represent the interests of students outside the United States and who might want to form a chapter in their country and join an international youth network.

Drug Testing for the Scrap Booking Club?

Parents of a student in the Delaware Valley School District have threatened a law suit over the student drug testing policy that requires all students to be tested if they want to participate in sports, extra curricular activities or have campus parking permits. The student in question wanted to be part of the scrap-booking club and her parents asked that she be exempt from the testing.
