WHAT IS THE BILL?
PA SB120 is “An Act providing for cannabis; regulating the personal use and possession of cannabis; establishing the Cannabis Control Board; providing for powers and duties of the Cannabis Control Board; establishing the Cannabis Regulation Fund; providing for disproportionately impacted area, for regulation of cannabis business establishments, for enforcement and immunities, for laboratory testing, for advertising, marketing, packaging and labeling and for preparation, destruction and regulation of cannabis, edible and infused products; imposing a sales tax and excise tax on cannabis, edible and infused products; establishing the Cannabis Regulation Fund; providing for cannabis clean slate and for miscellaneous provisions; imposing penalties; consolidating provisions relating to medical use of cannabis; transferring powers and duties of the Department of Health to the Cannabis Control Board; and making repeals.” This bill was introduced July 10th, 2025 by Senator Laughlin (R) and Senator Street (D) and referred to the Law and Justice Committee.
WHY SSDP SUPPORTS THIS BILL?
We have seen other Pennsylvania cannabis legalization bills, such as those suggesting a state-store model for cannabis sales in the commonwealth, taking the right to participate out of the hands of those in the legacy market, and those most harmed by cannabis prohibition. We support equity in cannabis legalization, and that means provisions like the ones PA SB 120 proposes.
- SB 10 ensures equitable licensing, prioritizing applicants from disproportionately impacted communities and small businesses.
- Includes Clean Slate provisions to expunge low‑level cannabis convictions.
- Protects patients and medical users, allowing existing medical permit holders to expand into the adult-use market.
- Regulates marketing, potency, packaging, and bans child-targeted ads, aiming for public health safety.
- Redirects revenue from cannabis sales toward public safety, medical marijuana assistance, equity grants, drug prevention, workforce development, and general funds.
